Terms and Conditions

1. Purpose

The undersigned (“Participant”) wishes to participate in Pilates classes, workshops, private sessions or other activities offered by Malibu Haus, whether in studio, online or at any other location (collectively, the “Activities”). Pilates involves physical movement and the use of specialized equipment; injuries may occur. This agreement outlines the Participant’s voluntary assumption of those risks and releases Malibu Haus from liability.

2. Voluntary Participation & Health Acknowledgment

Voluntary choice: Participant acknowledges that they have voluntarily chosen to participate in the Activities and may stop at any time.

Physical ability: Participant represents that they possess the level of health, strength, fitness and flexibility necessary to safely participate. Participant understands that Malibu Haus instructors are not medical professionals and do not diagnose, treat or prescribe for any medical condition.

Responsibility to consult a physician: Participant understands that it is their responsibility to consult with a physician before beginning or resuming any exercise program.

3. Assumption of Risk

Participant understands and acknowledges that participation in the Activities may be hazardous, involving risks of minor or serious injury, illness or death, including but not limited to sprains, strains, fractures, equipment malfunction, infections and exposure to contagious diseases. Participant voluntarily assumes all such risks, known and unknown, and accepts full responsibility for any injuries or damages that may result.

4. Release & Waiver of Liability

In consideration of being permitted to participate in the Activities, Participant, on behalf of themselves and their heirs, executors, administrators and assigns, hereby:

Releases and forever discharges Malibu Haus, its owners, officers, instructors, employees, agents and representatives from any and all claims, demands, or causes of action arising out of or related to any injury, illness, loss or damage resulting from participation in the Activities, including those caused by the negligence of Malibu Haus.

Waives any right to sue or otherwise hold Malibu Haus responsible for any such claims.

Indemnifies and holds harmless Malibu Haus from any and all liabilities or costs, including attorney’s fees, resulting from any claims made by third parties arising out of Participant’s conduct during the Activities.

5. Medical Treatment & Emergency Consent

Participant authorizes Malibu Haus to obtain emergency medical care on their behalf if deemed necessary and agrees to be responsible for any resulting medical expenses. Participant understands that Malibu Haus does not provide health or accident insurance.

6. Photography & Media Release

From time to time, Malibu Haus may record video or take photographs of classes for educational or promotional purposes. By booking or attending an appointment, Participant consents to the use of their image, voice and likeness in print or digital media for any lawful purpose without compensation. Participant may withdraw this consent at any time by notifying Malibu Haus in writing.

7. Cancellation Policy

Private session appointments must be cancelled or rescheduled at least 24 hours in advance to avoid being charged the full session fee. Late cancellations and no‑shows may incur the full class fee. All purchases are non‑refundable.

8. Miscellaneous

Severability: If any portion of this agreement is held to be unenforceable, the remaining provisions shall remain in full force and effect.

Governing law & jurisdiction: This agreement shall be governed by the laws of the State of Missouri. Any disputes arising under or relating to this agreement shall be resolved in courts located in Kansas City, Missouri.

Binding effect: This release applies to all current and future participation in Activities.

Acknowledgment

By checking the mandatory consent box or confirming your appointment, you acknowledge that you have read this agreement carefully, understand its terms, and agree to be bound by them. You understand that you are waiving substantial legal rights, including the right to sue Malibu Haus for negligence or any other claim.
